Procedure of Application for Work Permit in Vietnam

Application Procedure for Work Permit in Vietnam

1. A written request for a work permit from the employer;

2. The health certificate is issued overseas or in Vietnam as stipulated by the Ministry of Health;

3. The written confirmation is not offender or prosecuted for criminal liability in accordance with the law of Vietnam and foreign laws valid for a period of 06 months which effect until the application time;

4. Documents certifying the manager, executive, professional or technical worker, as follows:

a) For foreign worker is manager, executive must have one of the following documents:

- Documents as a proof of the manager, executive working position included work permit or employment contract or appointment decision has determined that the foreign worker was working in management position;

- Documents certifying the manager, executive from agencies, organizations and enterprise confirmed that foreign worker has worked.

b) For foreign workers are professional, technical worker, they must have one of the following documents:

- Foreigners who are professionals, technical workers if they meet requirements for training qualification or have at least 05 years of experience working in line with the position that foreigners expected to work in Viet Nam;

- Foreigners who have a diploma from a college or equivalent or higher and vocational training sector in line with the teaching profession at the training organization, language centers); preschool educational place;

- Foreigners who have a diploma from a university or equivalent or higher and vocational training sector in line with the teaching profession in general education establishments;

5. Text on the approval of the use of foreign workers or written decision on the contractors were recruited foreign laborers to work on position which cannot recruit Vietnamese employees of the City (Provincial) Department of Labour, Invalids and Social Affairs;

6. 02 color photos (4cm x 6cm size)

7. Copies of valid passports or papers in accordance with the law.

8. The papers relating to foreign workers

- Labor contracts;

- Written confirmation of the employer;

 - The decision to recruit foreign workers;

 - Certificate or insurance tax payment of foreign workers.
