Lawyer in Hanoi Consult in Anti-Corruption Law

Anti-corruption is of the goals of the National Strategy in the coming years. Understanding the role of the Anti-Corruption, individuals and organizations must be the pioneers in educational awareness for leaders and employees on the Anti-Corruption Law.

Beginning of 2017, at the invitation of the Board of Directors of the Penta-Rinkai, Japanese joint venture located in Hai Phong, lawyers at Dragon Law had a seminar to consult, exchange the Anti-Corruption Law to Penta-Rinkai’s officials, employees.

The seminar with participation of Penta Ocean leaders such as Mr.  Kazuo Aoki - Senior Administration Manager, Ms. Vu Thi Hoi Truong - Deputy General Director; and Dragon Law’s Mr. Nguyen Minh Long - Lawyer cum Director, Mr. Nguyen Duc Nang - Lawyer as well as other officers from Penta-Rinkai, Penta-Toa.

At the seminar, Dragon’s lawyers has shared the contents of the Anti-Corruption Law; expressions in practice as well as experience in the implementation process of the cases related to corruption.

Under the current law, individuals and organizations should comply with the following law and regulations:

- Law on Anti-Corruption in 2005;

- Law on Amending and Supplementing Some Articles of Law on Anti-Corruption in 2012

- Decree No.59/2013/ND-CP dated on June 17th, 2013 elaborating some articles of Law on Anti-Corruption

- Draft of Law on Anti-Corruption in 2016 (under consideration by the National Assembly 14)

Persuant to Article 3 of the Law on Anti-corruption in 2005, the following actions will be considered as corruption:

1. Property Embezzlement

2. Taking bribes

3. Abuse of positions or powers to appropriate property

4. Taking advantage of their positions and powers while on duty, self-seeking tool

5. Abusing powers while on duty, public duty for self-profit

6. Abusing positions and powers to influence other people for self-profit

7. Using fake job powers for self-profit

8. Offering bribes, bribe brokerage performed by people with high positions and powers to tackle the work of agencies, organizations or local units for their own benefits

9. Abusing positions and powers for illegally use of state property for their own benefits

10. Harassment for self-profit

11. Not carrying out public duties for personal interests

12. Abusing positions and powers to protect those who commit acts of violation of law for personal interests; hinder, interfere illegally in the inspection, billing, investigation, prosecution, adjudication and enforcement for self-profit.

In conclusion, leaders and staffs of the Penta joint venture have basic awareness of anti-corruption law, is advised the questions and issues on the current, amending and supplement law on anti-corruption. They have actively prepared to capture new legal provisions of anti-correction in the next approvals.
