International Registration for Patent

Legal Basis

- Law on Intellectual Property 2005;

- Decree No.103/2006/ND-CP;

- Circular No.01/2007/TT-BKHCN;

- Circular No.22/2009/TT-BTC;

- National Office of Intellectual Property (NOIP);

- International searching Authority;

- International Invention Office.

Form of Registration

Patent Registration under National Form:

- Patent registration under national form is that Client directly files application in each country proposed for patent registration.

- The application will be dealt with according to the law of each country.

Application under PCT with Vietnamese Origin

- International application: stated the appointed country protecting patent.

- International researching: The application from Vietnam is searched in one of IP agencies: Austria, Australia, Russia, Korea, Sweden; European Invention Office

- Application publication: International Office 

- International preliminary examination: give primary idea and not compulsory for the invention requesting for protection in International Application which meet the standard of innovation and whether have the ability to PCT application or not on order to help the company to have the chance to evaluate again about the ability to grant the patent before pay necessary fee and charge for application.

- Deal with the application in national period: After ending the international period, the application is evaluated again according to the law of each appointed country.

Necessary Information to Dragon Law

- Applicant;

- Patent applied for local country (if any);

- Description of invention (Dragon Law will translate into English);

- List of countries appointed to protect patent so that Dragon Law can give the detail of quotation to Client.
