Copyright and Relevant Rights Registration Procedure

Dossier for Copyrights and Related Rights Registration

1. Written declaration about copyright and related rights registration

Individual, organizations applied for copyright registration use “Form 1”: Written declaration about copyright registration; the performers, producers of audio and visual records.

Broadcasting organizations register for related rights use “Form 2”: Written declaration about related rights registration. The written declaration shall be made in Vietnamese, filed and signed by author, the copyright holder, the related rights holder or person authorized to file application; and must include all information about the applicants, authors, the copyright holder or the related rights holder; summarize the content of composition, the performance,  the record and visual records or the broadcasting program; The author name, the composition used to make the derivative composition if the registered composition is the devivative one; the date, place and form of publication; and undertaking information in the application.

2. Two copies of composition applying for copyright registration or two copies of formulated objects that applying for related rights registration

One copy saved in Copyright Department, one sealed and numbered the Certificate of registration and send back for the granted Subject.

For specific composition such as: pictures, statues, monuments, embodiment, relief, the super picture associated with buildings; composition with oversized, cumbersome, the copy of this composition shall be replaced by a three – dimensional snapshot.

3. A letter of authorization if the applicant is authorized;

4. The document proving the right to file the application, if the applicant acquires such right by inheritance, succession or assignment;

5. The written consent of co-authors, if the composition made by co-authors;

6. The written consent of co-owners, if the copyright and related rights are jointly owners.

The documents stipulated in point 3, 4, 5 and 6 must be written in Vietnamese; documents in a foreign languages must be translated into Vietnamese and notarized or authenticated. If the enclosed documents are copies, they must be notarized or authenticated.

Re-grant, Renewal Certificates

If authors, the copyright holders, the owner of related rights want to re-grant or change the certificate, when file the application, they must state the reason and apply one dossier according to Article 50, Law on Intellectual Property.

The Copyright Department re-grants the certificate in case the certificate lost, the Copyright Department change the certificate in case the certificate torn or changed the owner of copyright and related rights;

Cancellation to Effectiveness of Certificate

In case the person granted Certificate is not author, copyright holder, related rights holder as well as the registered composition, the registered record, the registered visual fixation and broadcasting program don’t belong to protection objects, the Copyright Department will cancel the effectiveness of granted certificates.

The organizations or individual detecting the certificate is granted contrary to Law on Intellectual Property have the right to request the Copyright Department to cancel the effectiveness of Certificate.
