Why we should register for industrial design protection?

Industrial design registration is necessary to protect your intellectual results.

The Law on Intellectual Property was passed by Legislature XI of the National Assembly of the Socialist Republic of Vietnam at its 8^th session on 29 November 2005 and was full force and effect as of 1 July 2006.

When an Industrial design was registered, it shall be the exclusive design of the business. When registration, the business has the exclusive rights to exploit the Industrial design for commercial purposes (production, circulation, export, import the product of this Industrial design). During the time of protection, any person using this Industrial design is not permitted by the owner, they shall be considered an infringement of right and dealt with such breaches according to the Law.

The business need apply to Industrial design registration for its product before putting the product on the market. Because if putting the product on the market without protection registration, it is vulnerable to imitate. If the person imitating this product apply for registration, the business shall face many difficulties.

The department of Intellectual Property will issue a unique permit to the earliest applicant of applicants applying in the same time and meeting all criteria for protection. ("First to file" principle).
