Question:

If the enterprise’s business operation is suspended, how can I complete my procedures of social insurance?

Answer:

In case the employees want to settle unpaid compulsory social insurance premiums by themselves, pursuant to Paragraph 1, Article 19; Clause 2, Article 21; Paragraph 1, Article 85 and Paragraph 1, Article 86 of the Law on Social Insurance, there is no basis to pay compulsory social insurance by theirselves, including the payment responsibility of the employer.

In case the employees continue to pay compulsory social insurance, according to Point a, Paragraph 1, Article 2 of the Law on social insurance 2014, if employees continued working under an indefinite-term labor contract, definite-term labor contract, seasonal or work-specific labor contract which has a duration of from 3 months to under 12 months at the new unit (different unit), they would be covered by compulsory social insurance.

On participating procedures, the employees shall make a declaration and change information of social insurance, health insurance and unemployment insurance participants (Form TK1-TS) promulgated and enclosed with Decision No. 959/QD-BHXH dated September 9, 2015 of The General Director of Vietnam Social Insurance to submit to the unit where they work, then apply dossier to the social insurance agencies.

In case the employees shall not be covered by above compulsory social insurance, the employees can pay voluntary social insurance. Thus, the employees shall make a declaration and change information of social insurance, health insurance and unemployment insurance participants pursuant to Form TK1-TS promulgated and enclosed with Decision No. 959/QD-BHXH, submitting declaration and making payment to district-level social insurance agencies or ward agent of localities.
